香港法院在最近由陈美兰法官在Chimbusco International Petroleum (Singapore) Limited v Fully Best Trading Limited（沛佳贸易有司限公）[2015] HKEC 2573案作出的判决中阐明，在缺乏特殊情况之下，法庭在挑战仲裁协议不果的案件中，应颁令按弥偿基准计算讼费。
